Israeli soldier's Facebook photos: Who's right, the IDF or Abergil? Former Israeli soldier Eden Abergil touched off a storm of criticism in the Middle East this week after she posted Facebook photos of her mugging in front of bound and blindfolded Palestinian detainees. the photos as "base and crude," but Ms. Abergil and her friends seem to have gotten a kick out of the pictures before she says she took them down, sometime in the past 24 hours. When one of her friends wrote "that looks really sexy" of a picture of her posed in front of two Palestinian prisoners, Abergil responded: "I wonder if he is on Facebook, too ? I'll have to tag him in the photo." She has defended herself in the Israeli press, telling Army Radio that the pictures were just "souvenirs." So who's right here, the IDF spokesman or Abergil? As it happens, they both could be. Israeli soldier Facebook photos: Youth culture and rules of war collide Some context: Soldiers, particularly young soldiers, the world over tend to be fond of black humor and of mocking the enemy ? and can be less sensitive to pictures of detainees or images of violence than their civilian counterparts. Sometimes it's fairly gentle ? as in the common practice among soldiers in Iraq in 2005-2006 of calling Iraqis "durga durgas" a nod to the fake Arabic spoken by some of the puppets in the movie "Team America: World Police." Other times the mocking is even darker, as in the unwise slogan I once saw stenciled on a tank gun in Baghdad (not printable in the Monitor, but essentially an insult to the God of Islam). But none of it is surprising, given the daily realities of combat and tense operations, whether it's IDF soldiers in the occupied West Bank or US infantry patrolling Baghdad. When I covered the Iraq war for this newspaper, soldiers from multiple units showed me pictures of them posing with blindfolded detainees ? photographs much like the ones Abergil posted on Facebook ? and often standing over or near dead insurgents. Every infantry company seemed to have one or two guys interested in movies who would compile still images and video footage on their laptops into short clips that included the chaos of combat, gruesome photos of defeated enemies, and more standard pictures of comrades-in-arms relaxing on a forward operating base before their next operation. This "war porn," as some called it, was often passed around between units though most soldiers appeared to understand the US and international rules against posting such images. It's pretty formulaic: an accompanying speed metal or gangster rap track, shaky footage of combat from the ground and clips from the gun cameras of helicopter gunships wiping out insurgents on the ground with machine gun or missile fire. The soldiers I knew were certainly desensitized to this stuff. The general reasoning among the infantry was they'd been trained to be aggressive, to kill their enemies or be killed, and to do so was honorable and just. But to be told that recording or broadcasting such acts was criminal or improper didn't sit well with the soldiers. I was fortunate enough not to be involved in much heavy combat myself while in Iraq, but found after a few years that I'd become desensitized, too. In 2005, I had a small part in a film about Iraq that a friend of mine had written. On the set one day, Connie Nielsen, one of the stars, approached me and said she had a scene coming up in which she'd have to show a lot of grief and emotion over the violence of the war. She asked me if I could talk to her about it. What is it really like? I thought for a minute, and then told her I could go one better. I pulled out my laptop, where I had a 12 minute video a soldier had given me (on the proviso that I never put it on the Internet). I pushed play. She watched, said "I had no idea" and went to perform in her scene with tears streaming down her cheeks. Me? I'd been laughing about the choice of music and some of the over-dramatic touches in the brief clip a few days before.

Google to Alter Keyword Ad Policy in Europe PARIS ? The Internet giant Google said Wednessday that it would change its search policy for most of Europe to allow advertisers to buy and use terms that have been trademarked by others as keywords. Previously, brand owners could file a trademark complaint with Google to prevent third-party ads from being returned alongside the results of a search of a trademarked name, such as Louis Vuitton or Prada. The decision will be effective Sept. 14 and extends to the rest of Europe changes that were made in Britain and Ireland in 2008. In the United States and Canada, Google has been implementing the policy since 2004. Google?s move stems from a decision by the European Court of Justice in March. The court broadly ruled that Google had respected trademark law by allowing advertisers to bid for keywords corresponding to third-party trademarks. Brand owners, led by the French luxury goods company LVMH Moet Hennessy Louis Vuitton, had argued that only they or authorized sites should be able to buy and use such trademarked terms in searches, so as to protect their brand value. They now face the prospect of having the ads of third-parties offering their products being displayed in search results. Trademark owners who feel that third-party ads confuse users as to the origin of the goods and services will still be able to file complaints with Google, and the search company said it would take down the ads if it agrees that they are confusing. Dominic Batchelor, a London-based corporate partner at the legal firm Ashurst, said the decision ?will come as a blow to rights holders? in the battle ?over policing content in a challenging online environment.? ?The onus will be on rights holders to monitor and assert their rights,? he said. ?How readily Google responds to complaints about infringing use remains to be seen.? Ben Novick, Google?s communications manager for the region, stressed that the company would continue banning ads for counterfeit goods. ?We work with multiple brands to identify counterfeit goods,? he said. Google?s clients are now being informed of the changes. Legal experts have said that the European ruling stopped short of the definitive precedent that Google and brand owners alike had sought. Instead, it contained caveats that could result in a new flurry of lawsuits over the sale of ?sponsored links? generated by Google searches. Google argues that selling brand names as ad keywords to multiple bidders helps consumers because it allows them to find product reviews, sellers of second-hand goods and other information. It stressed that the new policy would not extend to the actual display text in search findings. ?Users will benefit from seeing more relevant ads following a search on Google,? Mr. Novick said. After the introduction of the changes in Britain and Ireland there was disquiet among some advertisers, he said, followed by ?a period of calm within a few weeks.? The changes will benefit the company?s hugely successful Adwords service, through which advertisers bid for key words and their ads are ranked based on the price paid and other variables. The system works on a pay-per-click basis. The company would not speculate on how much additional revenue the decision might bring. Adwords is the bedrock of the company?s success, accounting for approximately 95 percent of revenue. In the second quarter, Google?s revenue rose to $6.82 billion, from $5.52 billion in the equivalent quarter a year ago. Net profit rose to $1.84 billion from $1.48 billion

Seven Banks in Europe Fail ?Stress Test? for Scant Capital FRANKFURT ? Seven of Europe?s 91 largest banks would struggle to survive an unexpected decline in economic growth or a sharp deterioration in the value of European government bonds, and will need to raise more capital, regulators said Friday in releasing results of closely watched bank stress tests. Banks to flunk were Hypo Real Estate, a bank based in Munich that is already government-owned after a bailout, ATEBank of Greece and five Spanish savings banks. Several other banks passed the test, but narrowly enough that they may also face market pressure to increase their reserves. That group included Postbank, one of Germany?s biggest publicly traded banks, which is 25 percent owned by Deutsche Bank. Governments in the countries affected, or the banks themselves, said they were ready with measures to raise more money for banks whose reserves were considered too low to withstand the worst-case outlooks. After months of turmoil in markets caused by Europe?s sovereign debt crisis and its effects on the banking system, governments and investors alike were looking to the tests to see if Europe could demonstrate that it was finally confronting the problems and dealing with them head on. Whether the tests succeed in reviving confidence depends on whether investors and analysts believe they were severe enough to expose vulnerable banks. ?The stricter the better for the euro,? said Adam Cole, global head of foreign exchange strategy at RBC Capital Markets. Nicolas Veron, a visiting fellow at the Peterson Institute for International Economics in Washington, called the level of detail released ?disappointing.? ?Investors cannot reverse-engineer the results and apply their own assumptions,? he said. Bank regulators and central bankers insisted that the tests were rigorous and that fears about the stability of European banks were overblown. ?It is a very serious test,? Franz-Christoph Zeitler, a member of the executive board of the Bundesbank, Germany?s central bank, said at a news conference in Frankfurt. ?All this criticism was absolutely premature.? The stress tests, similar to an exercise conducted in the United States last year, were intended to rebuild confidence in European financial institutions that has been shaken by the sovereign debt crisis. Uncertainty about which banks may be sitting on piles of Greek debt and other potentially toxic assets has made institutions reluctant to lend to each other as well as to businesses, and acted as a drag on economic growth. Some banks had already moved to raise capital ahead of the results. National Bank of Greece, which passed the test, said Friday that it sold ?450 million, or $580 million, of 10-year bonds to bolster its regulatory capital. ?The sale process was completed within just four days, reflecting the investment community?s confidence in N.B.G.,? the lender said. Banca Civica, a merger of three smaller savings banks in Spain, failed the test. But it said ahead of the results that it had signed an agreement with J.C.Flowers, a U.S. buyout firm, to place ?450 million in convertible bonds. Hypo Real Estate said the stress test had ?limited relevance? because it was already in the process of transferring troubled assets to a so-called bad bank underwritten by the German government. Miguel Angel Fernandez Ordonez, governor of the Bank of Spain, told a new conference that the stress test results vindicated the recent push to force the savings banks, or cajas, to consolidate, as well as the regulatory overhaul to open up their capital to more investors. The tests were evidence of ?the enormous means? of the Spanish banking sector to overcome a crisis, he said. ?When there are doubts, you have to be absolutely transparent, and this is what we have done.? In addition to Banca Civica, four other unlisted Spanish savings banks failed: Diada, Unnim, Espiga and CajaSur, which was bailed out by the Bank of Spain in May. In a potential blow to the tests? credibility, regulators did not examine whether banks could withstand a debt default by Greece or any other European country. European authorities ? in contrast to many economists ? consider such a possibility unthinkable. In a compromise, banks were scheduled to detail their holdings of Greek, Spanish, Portuguese and other sovereign bonds. But a report released by the European bank supervisors did not contain that information, which would clear up intense speculation about which banks are most exposed. To pass the tests, a bank?s Tier 1 capital, a measure of reserves, had to not drop below 6 percent of assets in the face of a new recession and a sovereign debt crisis.
